Welcome to Wiggly Stuff! The terms “we”, “us” and “our” refer to Wiggly Stuff, an online store based in Victoria, Australia. We operate this website (wigglystuff.com.au) and all related information, content, features, tools, products and services (the “Services”) to provide you with a curated shopping experience. Wiggly Stuff is powered by Shopify, which enables us to provide the Services to you.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.

1. Accounts and Eligibility

  • You must be at least 18 years old, or have permission from a parent or guardian, to use our Services.
  • You agree to provide accurate and up-to-date information when creating an account or making a purchase.
  • You are responsible for maintaining the confidentiality of your login details and all activity under your account.
  • You may not transfer, sell, assign, or license your account to another person.

2. Orders and Payments

  • Placing an order is an offer to purchase. We will confirm acceptance via email once payment is processed and your order is accepted.
  • Prices are displayed in the currency shown at checkout. Where applicable, taxes may be included or calculated at checkout depending on your delivery country/region and the products purchased.
  • Payment must be made at the time of ordering. We accept common payment methods including Visa, MasterCard, PayPal, and Afterpay (where available at checkout).
  • We reserve the right to correct pricing errors and to cancel orders affected by incorrect pricing or obvious errors.
  • You agree to provide current, complete, and accurate purchase and payment information, and to promptly update your details so we can complete transactions and contact you if needed.
  • Your purchases are for personal or household use only and not for resale.

3. Product Information and Availability

  • We make every effort to ensure our product descriptions and photos are accurate. However, due to the nature of 3D printing, minor variations may occur.
  • Colours may appear differently depending on your device and display settings.
  • All descriptions and prices are subject to change without notice. We may discontinue any product at any time.

4. Shipping and Delivery

  • We ship within Australia and to selected international destinations. Available destinations and shipping services are shown at checkout.
  • Shipping rates and free shipping thresholds (if offered) vary by destination and are shown at checkout. International rates are generally calculated based on the total packaged order weight.
  • Authority to Leave (Australia): Parcels may be left in a safe place unless you request a signature on delivery (where available).
  • International deliveries: Final delivery is handled by the destination postal network. Delivery instructions, safe drop availability, and local handling can vary.
  • Delivery timeframes are estimates only and can be affected by factors outside our control (including carrier delays, customs processing, and service disruptions).
  • We are not liable for delays once the order has been transferred to Australia Post or another carrier, but we will provide tracking and reasonable support to help investigate issues.

5. Returns and Refunds

  • We do not offer refunds for change-of-mind purchases. See our Refund Policy for details.
  • If your order is damaged, faulty, incorrect, or not as described: Please contact us as soon as possible and within the timeframes set out in our Refund Policy, including providing proof (photos) where requested.
  • Do not return items without contacting us first. Returns sent without approval may be refused or delayed.
  • Nothing in these Terms affects your rights under the Australian Consumer Law. You may be entitled to a replacement, repair, or refund if goods are faulty, unsafe, or significantly different from their description.

6. Duties, Taxes & Import Fees (International Orders)

  • For international orders, import duties, taxes, and fees (if charged) are the responsibility of the recipient, unless otherwise stated at checkout.
  • If a parcel is refused due to unpaid fees and returned to us, re-shipping costs may apply.

7. Intellectual Property

  • All content, designs, images, branding, and product names on this site are the intellectual property of Wiggly Stuff or used under licence.
  • You may use our content for personal, non-commercial purposes only. Do not reproduce, distribute, or create derivative works without our written permission.

8. Optional Tools and Third-Party Links

  • We may provide access to third-party tools (e.g., label printing, analytics, or advertising integrations) that we do not monitor or control.
  • Use of third-party tools or links is at your own risk. Please review the third party’s terms and policies before using their services.

9. Data, Tracking & Privacy

  • We use cookies, tracking pixels, and similar technologies from third parties (including Google, Meta/Facebook & Instagram, Pinterest, TikTok) for analytics, marketing, and improving our Services. By using our site, you consent to these technologies as described in our Privacy Policy.
  • We share necessary order information with trusted service providers (e.g., SellerDash and Australia Post) for order fulfilment and tracking.
  • We may use email and marketing providers (including Mailchimp, Shopify Email, and Klaviyo) to send order communications and, if you opt in, marketing messages, as described in our Privacy Policy.

9A. SMS Marketing and Text Communications

  • How you opt in. By entering your mobile number at checkout, creating an account, signing up via a form, or otherwise choosing to opt in (for example, by ticking a box or responding to an SMS keyword), you consent to receive SMS/text messages from Wiggly Stuff. Marketing SMS is optional and is not a condition of purchase.
  • Types of messages and frequency. We may send you SMS messages about order and delivery updates, cart or browse reminders, product launches, promotions, special offers, and important updates about our store or Services. We aim to keep the frequency reasonable, but the exact number of messages may vary depending on your activity and our campaigns.
  • Opting out. You can opt out of marketing SMS at any time by replying STOP, UNSUBSCRIBE, or any other opt-out keyword described in the message, or by contacting us at support@wigglystuff.com.au and asking to be removed from SMS marketing. After you opt out of marketing SMS, you may still receive messages that are strictly necessary to complete your orders or comply with legal obligations, where permitted by law.
  • Charges and delivery. Wiggly Stuff does not charge you for receiving SMS messages, but your mobile carrier’s standard message and data rates may apply. Message availability, delivery, and timing may vary based on your mobile carrier and location. We are not responsible for delays or failures in message delivery.
  • Use of your mobile number. We will use your mobile number in line with our Privacy Policy, including to send messages you have consented to receive and to help manage orders, support, and customer service. We may share your mobile number with trusted third-party providers (for example, SMS gateway services or Shopify apps) solely to send SMS on our behalf or to support our Services. We will not sell or rent your mobile number to third parties for their own marketing.
  • Compliance. We aim to send SMS communications in accordance with applicable Australian laws, including the Spam Act 2003 (Cth) and the Privacy Act 1988 (Cth). If you believe you have received an SMS from us in error, please contact us at support@wigglystuff.com.au so we can investigate and correct the issue.

10. Relationship with Shopify

Wiggly Stuff is powered by Shopify, but any purchases are made directly with us. Shopify is not responsible for sales, refunds, or any loss, damage, or injury related to your purchases. By using our Services, you release Shopify and its affiliates from any claims related to your transactions with Wiggly Stuff.

11. User-Generated Content & Feedback

  • By posting reviews, photos, or submitting feedback, you grant us a worldwide, perpetual, royalty-free licence to use, display, reproduce, and adapt that content for marketing or promotional purposes.
  • You must own or have rights to any content you submit and ensure it does not infringe others’ rights or contain unlawful material.

12. Termination

We may suspend or terminate your access to our Services at any time without notice if you breach these Terms. Upon termination, your obligations under these Terms will still apply where relevant.

13. Disclaimer of Warranties

Our Services and products are provided “as is” and “as available” without any warranty, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted, secure, or error-free operation of our Services.

14. Limitation of Liability

To the fullest extent permitted by law, Wiggly Stuff will not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or savings, arising from your use of our Services or products. Our liability is limited to the purchase price of the item in question. Nothing in these Terms limits your rights under Australian Consumer Law.

15. Indemnification

You agree to indemnify and hold harmless Wiggly Stuff, our staff, partners, and service providers from any claims, damages, or expenses (including legal fees) arising from your breach of these Terms or your misuse of our Services.

16. Assignment

You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights or obligations without your consent.

17. Force Majeure

We are not responsible for any delay or failure to perform our obligations under these Terms if caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, strikes, war, or disruptions to transport, telecommunications, or utilities. In such cases, our obligations will be suspended for the duration of the event.

18. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of Victoria, Australia.
  • Any disputes will be handled in the courts of Victoria. You agree to attempt to resolve disputes with us first before seeking legal action.
